California breastfeeding women are protected in several ways.

Both Federal and California lactation laws provide protection to California women.

This means that your employer must provide you with break time and an appropriate location for you to pump and store breastmilk. Read More

Both Federal and State laws say that your employer must not discriminate because you are breastfeeding.  This means that they must respect your need for accommodations and ensure that you are not harassed or experience discrimination.

FEDERAL: The Civil Rights Act, Title VII, Pregnancy Discrimination Act has specific guidance that states “lactation discrimination is sex discrimination. Read More

CALIFORNIA: The Fair Employment and Housing Act definition of “sex” includes breastfeeding women. Therefore lactation discrimination is sex discrimination. Read More

California’s Pregnancy Disability law provides job protection for the time that you are disabled by pregnancy.  Read More

The Federal Family Medical Leave Act (FMLA) provides 12 weeks of job protection for employees who work for employers with 50 or more employees in a 75 mile radius and at least 1 year. Read More

California has form of paid maternity leave.

State Disability Insurance Fund: Look at your payroll deductions on a paycheck. If you paid into “SDI” and you are pregnant, you can apply for state disability insurance, while you are disabled by pregnancy and childbirth (55% of your pay.) Read More

Paid Family Leave: After your pregnancy disability, you are also eligible for 6 weeks of Paid Family Leave (55% of your pay), however you may NOT have job protection if you work for an employer with less than 50 employees. Read More
